I have seen Toby play this song on GAC and he plays with a capo on 2.  This is more 
accurate than the other versions and is easier to play.

I watched Toby Keith play this song live on CMT several times and in
concert. He plays an E chord in place of the Em. I think it sounds
good.

yes i have also seen toby on cmt...at the beginning when its just him playing the intro does anybody know the strumming pattern?

This is lightyears later, but I believe the reason everyone is confused on E is because only the first 4 strings are capoed. Leave B and E open, use an E chord instead of the Em - it makes a difference, even with the rest of the chords.
