If you play it with the album, it's capo 3.

by the album, the capo is on the 3rd fret, though live i've seen him play it in the 1st position

If he played in first position then he probably changed keys. The solo on this site is in F so I would say the Key of D with a capo on three and that would make F.

In this version it sounds good if you play D7 on the word testify in the chorus try it, it is an added edge!
