I saw Vince play this song on CMT. You are correct that there is a capo 1st fret, but the song is a C to F to whatever. I forgot the rest, but its def. not in a D.

I am watching this song right now at "Sessions at AOL". He has Capo II and
just going back and forth C to F mostly
with some bass runs worked in. If you can,
take a look.

Album version is done with Capo on 1st fret. The posted tob is mostly correct. After the 2nd walking base during the verse I believe there should be an "A" chord/strum prior to going back to "D".

Put the capo on the 3rd fred and play out of a "C" chord form, and you will have the recoded key, (which is, as you said, "D#")
This is the way Vince plays it most of the time, and the way it was recorded.. If you want to play it in a "D" chord form, capo on the 1st, and drop the low "E" string to "D" ... But heck, there are many ways to play it.. They're all good ... ;O)
